COLLECTING POINTS WITH THE BRICK KILN REWARDS APP

Collect 2 points for every £1 spent (100 points equals £2). Exclusions apply and you cannot collect loyalty points on the value of loyalty vouchers, money-off coupons, Brick Kiln gift cards, HTA gift cards/vouchers and delivery and assembly charges. We will notify you of your points voucher via email and notifications 3 times a year, and your voucher will appear in your app. The terms and conditions for spending your points voucher will appear with the voucher in your app.

GENERAL TERMS AND CONDITIONS BRICK KILN GARDEN CENTRE GIFT CARDS

1. The gift card can be used in full or part payment against purchases from Brick Kiln Garden Centre.

2. The minimum amount required to activate this gift card is £5.

3. It cannot be exchanged for cash, neither is it a credit, charge, debit or cheque guarantee card.

4. No change will be given but the balance can be exchanged for future purchases. We will not be held liable for lost, damaged or stolen cards, so please look after this card just like cash. 

5. Where goods purchased with the gift card are exchanged for goods of a lower price or refunded, the monies owing will be returned by issuing and activating another gift card.

6. This card will expire after 36 months after activation.

7. Damaged altered or cancelled cards will not be accepted.

8. Brick Kiln Garden Centre reserves the right to amend or waive these terms and conditions or terminate this scheme upon reasonable notice.

GENERAL TERMS AND CONDITIONS FOR EVENTS

These terms and conditions shall apply to your purchase of tickets for Events at Brick Kiln Garden Centre.

Please read these terms and conditions carefully, particularly the section regarding cancelling or amending your tickets. By ticking the ‘I agree to the terms and conditions’ box, you are confirming that you are happy to be legally bound by these terms and conditions.

If you do not agree to these terms and conditions, you should not tick the ‘I agree to the terms and conditions’ and you should not continue with the purchase of tickets for events at Brick Kiln Garden Centre.

1. Event Tickets

1.1 Admission to any event at Brick Kiln Garden Centre is only accepted upon receipt of a valid ticket, purchased in accordance with our ticket purchasing terms and conditions below. 

1.2 Your ticket must be presented in printed form or viewable on a mobile device. Brick Kiln Garden Centre reserve the right to request proof of identity before allowing admission to any event. 

2. Purchasing Your Tickets

2.1 Tickets to events are available to be purchased online via www.brickkilngardencentre.co.uk or via one of the till points within the Garden Centre. In both cases, you will be emailed confirmation of your ticket and are subject to availability.

2.2 Payments for tickets online shall be made using the online payment facility which is provided by PayPal. We do not store your payment card details.

2.3 Your ticket is only valid for the event, date and time specified on your ticket.

2.4 Unlawful resale (or attempted unlawful resale) of a ticket will result in the cancellation of that ticket without refund or other compensation.

2.5 We will not be responsible for any tickets that are lost or stolen. You will be responsible for ensuring that you have a valid ticket ready to be inspected upon your arrival at the event at Brick Kiln Garden Centre.

3. Cancelling or Amending Your Tickets

3.1 Tickets to events at Brick Kiln Garden Centre are non-refundable.

3.2 Brick Kiln Garden Centre may cancel or reschedule your event at any time at our absolute discretion. If a suitable timeslot or amended date cannot be found, we will then offer you a full refund.

3.3 In the event of changes to government guidance due to covid-19 that require us to cancel this event, your ticket fees will also be refunded.

4. Arrival

4.1 You must arrive at least TEN (10) minutes in advance of your allocated time slot. We will use our reasonable endeavours to admit latecomers, but late admission cannot be guaranteed.

4.2 You shall be responsible at all times for ensuring the correct and safe supervision of all children in your group.

5. Photography

5.1 You are permitted to take your own photographs during your visit to Brick Kiln Garden Centre on the strict condition that all photographs consist of your family members only. It is important that other guest’s privacy is respected at all times during your visit.

5.2 By purchasing an event ticket at Brick Kiln Garden Centre, you are granting us the right to take photographs of your visit and edit all resulting materials for publicity in any manner we deem fit so long as it is in connection with the event that your ticket was purchased. For example, we may include photographs of your visit on Brick Kiln Garden Centre’s social media channels and any public relations materials.

6. Your Privacy

6.1 By providing your personal information to us when you purchase your ticket, you consent to us processing your data in accordance with these terms and our privacy policy.

6.2 The personal information you provide to us when you purchase your ticket is held by e-availability, a third party supplier that we use to provide the online platform your tickets are booked through. 6.3 Your personal information is collected and stored in accordance with the Data Protection Act 1998.

7. Liability

7.1 Our liability for any losses you and/or any of your guests may suffer as a result of us breaching these Terms and Conditions or for any breach of any statutory duty or negligence or otherwise is strictly limited to the total purchase price of your event tickets.

8. Events Outside Our Control

8.1 Brick Kiln Garden Centre will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by any event outside our reasonable control (“Force Majeure Event”).

8.2 A Force Majeure Event (without limitation) includes the following:

a. Strikes, lock-outs or other industrial action;

b. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

d. Impossibility of the use of public or private telecommunications networks;

e. The acts, decrees, legislation, regulations or restrictions of any government; and/or

f. High winds or any other extreme weather conditions which necessitate the closure of the Location for the safety of our volunteers, staff and customers.

8.3 Our performance under these Terms and Conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to provide a suitable alternative date on which you can enjoy your event.

9. Law and Jurisdiction

9.1 These Terms and Conditions and the terms of our Privacy Policy shall be governed by and construed in accordance with the laws of England. You accept that any dispute under these Terms and Conditions and/or our Privacy Policy shall be subject to the exclusive jurisdiction of the English courts to which you submit.

10. Complaints

We accept that, despite every effort being made to ensure you have a trouble-free, enjoyable event, things may occasionally go wrong. If you have a complaint you must inform a member of staff immediately. They will attempt to resolve the problem as soon as possible. If, however, an acceptable solution is not found and you wish to take the matter further, please email us (marketing@brickkilngardencentre.co.uk) detailing in full the nature of the complaint, wherever reasonably practicable within 3 days of your visit. This will allow us to investigate your complaint fully.

SOCIAL MEDIA COMPETITIONS AND PRIZE DRAWS TERMS AND CONDITIONS 

Santa’s Grotto and Festive Family Meal Giveaway – 07/09/23

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions and by participating all claimants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

1. Promoter: Brick Kiln Garden Centre Limited, Bognor Road, Chichester, PO20 1EJ. 

2. Eligibility: The draw is open to all UK (England, Scotland, Wales and Northern Ireland) and ROI residents who are 18 years or over excluding employees and their immediate families of Brick Kiln Garden Centre Limited, its agents, retailers or anyone professionally connected with this promotion. 

3. Promotional Period: The competition opens for the receipt of entries on 7th September 2023 at 5 pm and closes at midnight on 14th September 2023. The draw will take place on 15th September.

4. Entry Instructions: Entry is made via the corresponding competition post on the Brick Kiln Garden Centre Facebook or Instagram page, where the entrant must like the competition post & comment with #FestiveFamilyFun, the entrant must all be following the Brick Kiln Garden Centre account. Multiple entries are allowed. Incomplete, illegible, misdirected or late entries/claims will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries or claims delayed, incomplete or lost due to technical reasons or otherwise. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries or via third parties or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified. If it becomes apparent that a participant is using a computer(s) or multiple aliases to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that person’s entries will be disqualified and any prize award will be void. No purchase necessary. 

5. The Prize: The winner will receive: 2 x tickets to Santa’s Grotto, 2 x children’s festive meals and 2 x adult festive meals on a date agreed with Brick Kiln Garden Centre and the winner.

6. Winner Selection: There will be one (1) winner selected from the Facebook entries & from the Instagram entries, collated together, producing a randomly selected winner no later than 15th September. 

7. Winner Notification: The successful corresponding Facebook or Instagram user will be notified via private message or comment through Facebook or Instagram and will have 5 days to claim. In order to claim a prize the promoter may ask for a copy of your passport proving your legal name at the time of entry, both must match in order to validate a prize. In the event of a non-claim, the promoter reserves the right to reallocate the prize with no liability. 

8. General: No responsibility can be taken for entries or claims which are lost, delayed, corrupted, damaged, misdirected or incomplete or cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. There are no cash alternatives to the prizes available in whole or in part except in the event of circumstances outside its control the Promoter reserves the right to substitute a similar alternative of equal or greater value. Unless otherwise agreed in writing by the Promoter the prize will only be awarded directly to the winner. The Promoter does not guarantee continuous uninterrupted or secure access to the website. Numerous factors outside the control of the Promoter may interfere with the operation of the Website. No responsibility will be accepted for any difficulties in entering or any entries delayed or corrupted. The decisions of the Promoter are final in all promotional matters. For the winner(s) full names and counties please write to the promoter within 3 months of the closing date enclosing a self-addressed envelope, please mark your envelope for the attention of the Marketing Department. If selected, each individual grants Brick Kiln Garden Centre Ltd and its agents the right to use their name and county in any publicity carried out by Brick Kiln Garden Centre in any and all media worldwide now known or hereinafter developed, for a fixed period of five years and without further consideration or notice to the participant. Any question concerning the legal interpretation of the rules will be based on English law and the English Courts will have exclusive jurisdiction. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

 

GENERAL TERMS AND CONDITIONS

1. Definitions
The following words shall have the following meanings unless the context of their use requires otherwise:
“Company” shall mean Brick Kiln Garden Centre.
“Contract” any contract between the company and the customer for the supply of the goods or the carrying out of the work.
“Customer” shall include any person, firm, or body corporate for whom or at whose request work is done or services rendered.
“Work” means all the work or services undertaken or performed by the company.
“Goods” means all components, spare parts, goods, equipment, or materials of any kind agreed in the contract which are supplied or installed by the company whether in connection with the work or otherwise and the quantity and description thereof shall be as set out in the company’s quotation.
“Premises” means the company’s facilities at insert company address.

2. Contract
a) All quotations, purchase orders, confirmation of order, specification or other documents relating to the carrying out of the work and/or to the supply of the goods are subject to these terms and conditions to the exclusion of all other terms and conditions. These terms and conditions may be varied only by agreement in writing between the parties signed on their behalf by duly authorised representatives.
b) Quotations issued by the company are not offers capable of acceptance so as to make a binding contract but are instead invitations to place orders subject to these terms and conditions. Any orders placed with the company require its written acceptance before any contract arises. The customer shall ensure that the terms of its order and any applicable specifications are complete and accurate.
c) These terms and conditions (as varied if at all in accordance with sub-clause (a) above) comprise the whole contract between the parties and supersede any prior promises, representations, undertakings or implications. Nothing in this condition shall exclude or limit the company’s liability for fraudulent misrepresentation.
d) The company shall have the right to sub-contract any of the work either in whole or in part.
e) All orders and contracts shall be governed by the laws of England and Wales.
f) The failure of the company or the customer in any one or more instances to insist upon strict performance or observance of one or more terms or to exercise any remedy, privilege or right shall not be construed as a waiver of any future breach of any terms or rights to enforce the same or to exercise such remedy, privilege or right.
g) If any provision of these terms and conditions is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness be deemed severable and the remaining provisions of these terms and conditions and the remainder of such provision shall continue in full force and effect. 

3. Prices
a) All prices and rates quoted or agreed by the company are based upon costs prevailing at the date of such quotation or contract. 
b) Any quotation will only be valid for acceptance for a period of 30 days provided that the company has not previously withdrawn it. The prices and rates are exclusive of value added tax which shall be due at the rate ruling on the date of the company’s invoice. 
c) All payments to be made by the customer shall be made without any deduction or withholding (whether in respect of setoff, counterclaims, taxes, charges, discount, abatement or otherwise howsoever arising).

4. Taxes
a) The Customer will assume and pay and indemnify the Company against all taxes (including but not limited to withholding tax sales and use taxes but excluding any taxes relating or calculated by reference to income, profit or gains of the Company wheresoever imposed) duties, assessments, levies and fines and the costs of any customs bonds which may arise or for which the Company may be liable arising in any way out of the Contract.

5. Payment
a) The Customer undertakes to pay the Company for all Work, Goods or services provided within thirty days from the date of the Company’s invoice in the currency specified in the invoice.
